TWINCOUNSEL ACCEPTABLE USE POLICY (AUP)
This Acceptable Use Policy ("Policy") outlines the prohibited uses of the TwinCounsel platform, API, and services (the "Service"). This Policy is incorporated by reference into the TwinCounsel Terms of Service. Violations of this Policy may result in the immediate suspension or termination of your account (our "Kill Switch") and, in severe cases, legal action.
1. Professional & Ethical Restrictions
TwinCounsel is a tool for licensed legal professionals. You agree NOT to use the Service to:
- Unauthorized Practice of Law (UPL): Provide legal advice to third parties if you are not a licensed attorney or properly supervised legal professional.
- Pro Se Representation: Use the Service to represent yourself in legal proceedings if you are not a licensed attorney.
- Dual Representation/Conflicts: Process data in a manner that creates an unethical conflict of interest (e.g., uploading data from opposing sides of the same litigation into a shared workspace without waivers).
- Judicial Manipulation: Generate fabricated evidence, falsified court records, or misleading citations with the intent to deceive a tribunal or opposing counsel.
2. AI Safety & Adversarial Use
You are strictly prohibited from attacking or manipulating our AI models. You agree NOT to:
- Prompt Injection / Jailbreaking: Input commands designed to bypass safety filters, ignore system instructions, or force the AI to produce toxic, illegal, or unethical content.
- Model Extraction: Systematically query the AI to reverse-engineer its logic, extract model weights, or "distill" our proprietary knowledge graph into a competing product.
- Automated Hallucination Hunting: Intentionally overload the system with nonsensical queries solely to trigger errors for public defamation or competitive analysis.
3. System Integrity & Security
You generally agree NOT to:
- Scraping: Use bots, scrapers, or spiders to access or extract data from the Service (except for standard search engine indexing of public pages).
- Load Testing: Conduct unauthorized load testing, penetration testing, or vulnerability scanning without our prior written consent.
- Interference: Upload viruses, malware, or "logic bombs" (e.g., zip bombs) intended to disrupt service availability.
- Account Sharing: Share your login credentials with anyone outside your direct supervision (e.g., "pooling" seats to avoid fees).
4. Prohibited Content
You may not use the Service to process, store, or generate content that promotes hate, harassment, deepfakes, or acts of illegal commerce.
Representation Exception: The restrictions in this Section 4 shall NOT prevent a licensed attorney from processing materials (e.g., evidence of a crime, alleged trade secrets) when strictly necessary for the legitimate legal representation of a client, provided such processing complies with applicable laws, court orders, and professional ethical obligations.
Subject to the exception above, you may not use the Service to generate or distribute:
- Hate & Harassment: Content promoting violence, discrimination, or harassment.
- Deepfakes: Non-consensual sexual imagery or realistic synthetic media intended to defraud.
- Illegal Commerce: Sales of illegal drugs, weapons, or human trafficking.
- Unlawfully Acquired Data: Trade secrets or confidential information you do not have the legal right to possess.
5. Data Processing Restrictions
You agree not to:
- Process personal information of individuals without proper legal basis
- Use the Service to violate any privacy laws or regulations
- Upload or process data that you do not have the legal right to use
- Attempt to identify individuals from anonymized data
6. Intellectual Property Violations
You may not use the Service to:
- Infringe on copyrights, trademarks, or other intellectual property rights
- Generate content that plagiarizes existing works
- Reverse engineer or attempt to extract proprietary algorithms
- Create derivative works of copyrighted materials without permission
7. Enforcement & Reporting
- Monitoring: TwinCounsel reserves the right to monitor usage patterns (e.g., token velocity, error rates) to detect violations of this Policy.
- Immediate Action: We reserve the right to immediately suspend any account we reasonably believe is violating this Policy to protect our liability and system integrity.
- Reporting: If you discover a vulnerability or violation, please report it to security@twincounsel.com.
8. Consequences of Violations
Violations of this Policy may result in:
- Warning and required corrective action
- Temporary suspension of account access
- Permanent termination of your account
- Legal action and pursuit of damages
- Reporting to relevant authorities where required by law
9. Appeals Process
If you believe your account has been suspended or terminated in error, you may appeal by contacting legal@twincounsel.com with a detailed explanation. We will review appeals within 5 business days.
10. Updates to This Policy
We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email and posted on our website. Continued use of the Service after changes constitutes acceptance of the updated Policy.
